Terms of Service

1. Agreement to Terms

By accessing and using WebPino Softwares services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Services Description

WebPino Softwares provides web development, web application development, mobile app development, and related software development services. Our services include:

• Custom website development
• Web application development
• Mobile application development
• MVP development
• Dashboard and admin panel creation
• E-commerce platform development
• Maintenance and support services

3. Project Timeline & Delivery Guarantee

We commit to delivering projects within the agreed timeline based on project type:

• Landing Pages: 3-5 working days
• Business Website (15-20 pages): 10-15 working days
• Mid Level Projects: 20-30 working days
• E-commerce Basic: 25-35 working days
• Mobile App: 30-45 working days
• Large SaaS/Enterprise: 45-60 working days

Important: All timelines refer to working days, excluding:

• 5-Day Working Week: We work Monday to Friday only (Saturday and Sunday are non-working days)
• Company holidays (national holidays as per Indian calendar)
• Standard company leaves (will be communicated to you in advance)

Delivery Conditions:

• Complete and timely provision of all required materials by the client
• Scope remains unchanged after project commencement
• No delays caused by third-party services (payment gateways, APIs, hosting providers)
• Client availability for feedback and approvals within agreed timelines

4. Pricing & Payment Terms

4.1 Project Pricing: We offer transparent pricing plans starting from ₹1,500 for landing pages up to ₹1,25,000+ for enterprise solutions. Custom quotes are provided based on project requirements.

• Landing Pages: Starting ₹1,500
• Business Website (15-20 pages): Starting ₹15,000
• Mid Level Projects: Starting ₹35,000
• E-commerce Basic: Starting ₹45,000
• Mobile App: Starting ₹35,000
• Large SaaS/Enterprise: Starting ₹1,25,000

4.2 Payment Schedule:

• 50% advance payment required to start the project
• Remaining 50% due upon project completion and before final delivery

4.3 Third-Party Costs: The following costs are NOT included in our project pricing and remain the client's responsibility:

• Domain registration and renewal fees
• Web hosting charges
• SSL certificates
• Third-party API subscription fees
• Payment gateway charges
• Email service provider costs
• Premium plugins or licensed software
• Stock photos, fonts, or other licensed assets

4.4 Maintenance Plans: Monthly and quarterly maintenance plans are billed in advance.

5. Refund Policy

If we fail to deliver your project within the agreed timeline (excluding holidays and leaves) due to our fault, you have two options:

Option 1: 100% full refund - Complete money back with no questions asked

Option 2: 50% refund + Full project handover with source code and documentation

Note on 50% Refund: 50% refund means half of the total amount you have paid. For example:

• If you paid 50% advance (e.g., ₹25,000), you get ₹12,500 back
• If you paid full amount, you get 50% of total project cost back

Exclusions: Refunds do not apply to delays caused by:

• Client-requested scope changes
• Third-party service delays (APIs, payment gateways, hosting, domain transfers)
• Client delays in providing feedback or required materials
• Force majeure events

6. Intellectual Property Rights

6.1 Client Ownership: Upon full payment, all custom code and designs created specifically for your project become your property.

6.2 WebPino Rights: We retain rights to:

• Reusable code libraries and frameworks
• General methodologies and processes
• Portfolio usage rights (with client permission)

7. White-Label Services

For agency partners using our white-label services:

• Complete confidentiality and NDA compliance
• No direct client communication unless authorized
• Branding and credit remain with the agency
• Source code and documentation provided for client handover

8. Client Responsibilities

Clients agree to:

• Provide accurate and complete project requirements
• Respond to queries and provide feedback within agreed timelines
• Provide necessary access to servers, domains, and third-party services
• Review and approve deliverables in a timely manner
• Make payments according to the agreed schedule

9. Revisions & Changes

9.1 Included Revisions: 2-3 revision rounds are included in the project cost (varies by plan).

9.2 Scope Changes: Changes to the agreed scope will be quoted separately and may affect timeline and cost.

9.3 Major Revisions: Additional revision rounds beyond included quota will incur additional charges.

9.4 Post-Project Updates: After project completion and delivery, any new updates, changes, or feature additions will be charged at a minimum rate of ₹1,000 per day. Final charges will depend on the complexity of functionality and requirements involved.

10. Warranty & Support

10.1 Warranty Period: Free support period (1-3 months depending on plan) for bug fixes related to original scope.

10.2 Maintenance Plans: Extended support available through monthly or quarterly maintenance plans.

10.3 Third-Party Services: We are not responsible for third-party service failures or API changes.

11. Confidentiality

We maintain strict confidentiality regarding:

• Client business information and data
• Project details and requirements
• Proprietary information shared during collaboration
• NDA compliance for white-label partnerships

12. Limitation of Liability

WebPino Softwares liability is limited to the amount paid for the specific project. We are not liable for:

• Indirect or consequential damages
• Loss of profits or business opportunities
• Data loss due to client server issues
• Third-party service failures

13. Termination

13.1 Client Termination: Clients may terminate with written notice. Refunds calculated based on work completed.

13.2 WebPino Termination: We reserve the right to terminate for non-payment or breach of terms.

14. Dispute Resolution

Any disputes will be resolved through:

• Good-faith negotiation between parties
• Mediation if negotiation fails
• Arbitration in Gujarat, India as final resort

15. Governing Law

These terms are governed by the laws of India. Jurisdiction for any disputes is Gujarat, India.

16. Changes to Terms

We reserve the right to modify these terms. Clients will be notified of significant changes. Continued use constitutes acceptance of modified terms.
